This is an 16 year old battle for the Redskins, their team name. American Indians consider the name "Redskin" to be racially offensive and have been fighting to try and get the courts to cancel the Redskins' trademark so the team could no longer market its name. The plaintiffs have been working since 1992 to have the Redskins trademarks declared invalid. In 1999 they initially won when the U.S. Patent an Trademark Office panel canceled the team's trademarks. In 2003 the ruling was overturned in part because the suit was filed decades after the trademark was issued in 1967.
A U.S. district judge in Washington has sided with the Washington Redskins 2 days ago and says the plaintiffs have waited too long to bring their case to court. The judge added that the ruling does not decide "the appropriateness of Native American imagery for team names."
The youngest of the seven Native American plaintiffs waited too long after turning 18 to file the lawsuit. this plaintiff was 1 year old in 1967 and could not have taken legal action at that time. He turned 18 in 1984 and waited almost 8 years after coming of age to join the lawsuit.
The case now goes back to the U.S. Court of Appeals. If this court agrees with he recet ruling, then a group of Indians who filed a suit 2 years ago will be put in place. That suit has been on hold, so this case is till ongoing.
